This is the second professional website of international and US arbitrator and mediator Marc J. Goldstein, established in August 2025. Mr. Goldstein's primary professional website is www.Lexmarc.us, established in 2007. The creation of this second website is part of an effort to combat, through search engine optimization methods, the persistent prominent presence, in search engine search results for searches concerning Mr. Goldstein’s professional stature, of false and defamatory content about Mr. Goldstein on a particular anonymized website that presents the partisan positions of a party to a single arbitration as purportedly independent journalistic content. That website, and two related websites whose articles are hyper-linked within the texts of the articles found of the first such site, were apparently purpose-built to serve the tactical interests of parties that have been on the losing side of five unanimous Awards issued by an international arbitral tribunal of which Mr. Goldstein is the presiding arbitrator.
This is also explained on www.lexmarc.us in a Personal Note that details the relevant Awards, all of which have been public documents since March 2025. The Personal Note also quotes from and provides links to the US federal judicial decisions that have confirmed those Awards and that found the parties’ allegations (corresponding to the allegations on those websites) to have been without merit. The Fifth Partial Award, confirmed by the U.S. District Court in New York City on August 7, 2025, unanimously determined that two of the above-mentioned disparaging websites were created on behalf of the Respondents in that arbitration, that their creation constituted tortious interference with the contractual rights of the Claimants, that this was done with malice, and that punitive damages of more than $25 million were therefore appropriate.(The third such site only came to the attention of the Tribunal after the proceedings leading to the Fifth Partial Award had been closed). The Fifth Partial Final Award can be accessed as a link HERE and also on www.lexmarc.us.
If you have reached this website, it is likely because you or your clients have been invited to consider Mr. Goldstein for appointment as an arbitrator or mediator. Naturally you wish to consider all available information. But you should be aware of what constitutes malicious misinformation that remains online only because eradicating such misinformation is exceptionally difficult. Remarkably, on the most cyber-prominent offending website, which purports to be a journalistic endeavor with a mission to critically evaluate arbitration as a dispute resolution process, no arbitrator in any other case anywhere in the world is singled out for criticism. (this according to a ChatGPT response to precisely this question).
